Vendor Information
Booth spaces are 12’x12’.
Limited spaces are available with electricity, first come first served.
Food trucks will have access to electricity and water.

Vendor booths are available for arts & crafts, general sales, informational, farmer, baked goods.
No merchandise, booths, racks, or other items are to exceed the boundaries of your booth.
No vehicles will be permitted in the vendor area during festival hours.
ABSOLUTELY, No alcohol, drugs, profane language or vulgar conduct.
All vehicles must be removed from the festival area by 10:00 am prior to festival opening. Vehicles will be allowed to reenter the festival area after the festival has closed.
OakVine Village reserves the right to terminate the participation of any festival participant at any time with no refund.
Do not leave any garbage on the ground, especially plastic ties. Vendors that leave garbage on the ground will be banned from participation in future events.
Soliciting/distribution of materials or products outside of allotted vendor space is not allowed. Vendors are not allowed to move their vendor space. Information and giveaways will only be allowed within the vendor booth.
Food vendors are expected to comply with all Health Department regulations.
All vendors who use electricity, wood, charcoal, gas or propane will be required to have a working fire extinguisher in their space.
Check-In/Set-Up
Vendor check-in and set-up time is between 8:00 am – 10:00 am. All confirmed vendors (approved and paid) will receive further instructions before the event with a designated check-in time.
All vehicles must be out of the designated vendor loading/unloading zone no later than 10:00 a.m. on Saturday. ANY VENDOR NOT CHECKED IN BY 10:00 AM SATURDAY MAY BE TURNED AWAY WITHOUT REFUND. For security reasons, entrance to the venue at other times will be prohibited to incoming and outgoing traffic.
Sales Tax/City License
All vendors are required to charge, collect and pay city, county and state sales tax. Payment of taxes is the responsibility of each vendor, we do not collect sales tax from vendors. We will supply a list of all vendors, to the ALDOR or any other agency authorized to collect taxes/licenses, upon request. The sales tax rates are: Alabama 4%, Walker County 2%, Oakman City 4%. There is no special Oakman City license requirement for Day’s Gap Festival vendors. Vendors may need a Walker County Transient Merchant Business License.
Release/Indemnification Agreement
For and in consideration my being allowed to participate in the indicated Day’s Gap festival, I, the undersigned applicant, do hereby agree to release, acquit and forever discharge OakVine Village, its members, officers, agents, employees, servants, successors and assigns and all other persons, firms, corporations or other legal entities sponsoring, promoting, or otherwise associated with any Day’s Gap festival, from any and all claims, lawsuits, demands, actions, causes of actions, whether sounding in tort, contract, or other theory of law, whether for compensatory or punitive damages, whether known or unknown, which have previously existed now exist or could hereafter exist, arising from, connected with or otherwise related in any way whatsoever to my participation in any Day’s Gap festival. And furthermore I do hereby agree to indemnify and hold harmless OakVine Village for the payment of any claim, demand or judgment arising out of or related to my participation in any Day’s Gap festival, including the payment of the costs, expenses and reasonable attorney’s fees incurred by OakVine Village.
Certificate of Insurance
Food vendors are required to provide a certificate of insurance, showing OakVine Village LLC as “additional insured” for commercial general liability insurance to the OakVine Village. from a qualified A minus VII or better by A.M. Best, Inc. rated carrier in an amount not less than $1,000,000 per occurrence and $1,000,000 per aggregate event for injuries to persons or damage to property caused by Vendor, its agents, employees, contractors or guests, in connection with the performance of its obligations hereunder. Vendor agrees to name the following parties as additional insured on the above referenced policy: “OakVine Village LLC, and all direct owners, members, officers, shareholders, managers, directors, attorneys, employees and agents with respect to the actions of the named insured.”
Hold Harmless and Indemnification Agreement
Vendors that agree to participate in Day’s Gap Festival, agree to indemnify, hold harmless and defend the OakVine Village LLC, its officials, representatives, agents, servants, employees, volunteers and musical artist from and against any and all claims, actions, lawsuits, damages, judgments, liability and expense, including attorney fees and litigation expense, in whole or in part arising out of, connected with or in any way associated with my/our activities preparing for the Day’s Gap Festival, participating in Day’s Gap Festival or departing from Day’s Gap Festival. You will be required to acknowledge that you have read and fully understood the above Hold Harmless and Indemnification Agreement.
Limitations of Damages
OakVine Village will not be liable to vendors for any special indirect, consequential, or incidental damages arising out of or related to this agreement however caused and on any theory of liability (including negligence) and even if the vendor has been advised of the possibility of such damages. Further, in no event shall OakVine Village be liable for damages in excess for the total payments required to be made under this agreement.
No political merchandise is to be sold or displayed. No merchandise is to be sold or displayed promoting hate or violence.
Day’s Gap Festival does not discriminate on the basis of race, color, national origin, ethnicity, sex, religion or disability.
OakVine Village is a private entity. It reserves the right to refuse any applicants from the event for any reason.
